1. Agreement to terms

These Terms of Service (“Terms”) govern your access to and use of GrowthAccel's websites, products and services (the “Services”). By accessing or using the Services, you agree to be bound by these Terms.

2. Use of the Services

You may use the Services only in compliance with these Terms and all applicable laws. You are responsible for your account, your users, and the content and data you submit.

You agree not to misuse the Services, including by interfering with their normal operation or attempting to access them using a method other than the interfaces we provide.

3. Customer data

You retain all rights to the data you submit to the Services. You grant us the rights necessary to provide the Services. You are responsible for obtaining the consents required to process end-customer data, including for messaging and calling.

4. Fees and payment

Fees, if any, are described in your order or subscription. Unless stated otherwise, fees are non-refundable and exclusive of taxes.

5. Intellectual property

The Services, including all software, content and trademarks, are owned by GrowthAccel or its licensors and are protected by law. No rights are granted except as expressly set out in these Terms.

6. Third-party services

The Services may integrate with third-party platforms (for example, messaging and payment providers). Your use of those platforms is governed by their own terms.

7. Disclaimers

The Services are provided “as is” without warranties of any kind, to the maximum extent permitted by law.

8. Limitation of liability

To the maximum extent permitted by law, GrowthAccel will not be liable for indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues.

9. Termination

We may suspend or terminate access to the Services if you breach these Terms or as otherwise permitted in your order. Provisions that by their nature should survive will survive termination.

10. Governing law

These Terms are governed by the laws of India, and the courts of Bengaluru, Karnataka have exclusive jurisdiction, without regard to conflict-of-laws principles.

11. Changes to these Terms

We may update these Terms from time to time. Continued use of the Services after changes take effect constitutes acceptance.
